This topic notes details specific to the victim information that is included in the reparation report.

Emotional or physical harm

When preparing details on emotional or physical harm, the following factors must be included in the report:

  • details of the initial contact with the victim
  • an indication of the nature of the emotional or physical harm
  • any observations made during the interview with the victim
  • significant changes in the victim's personal circumstances as a result of the offence
  • details of any consequential loss or damage
  • any statement from a professionally-qualified source relating to long-term harm, and
  • information on any actual or potential entitlement under the IPRC Act.

The nature of the harm must be clearly described and this must be supported by evidence.

With the victim and/or legal guardian's consent, make inquiries with family members, victim support groups and doctors.

Note: If the victim is not prepared to supply this information, this factor is not to be taken as prejudicial to their interests.

Victim's view on payment

Include what the victim considers an appropriate payment to be, including:

  • costs already incurred by the victim, their family or support group(s)
  • an estimated total of expenses as a direct consequence of the offence
  • the amount of reparation agreed to, and
  • the rate of payment if agreement was reached.

This includes any consequential loss or damage, such as wages and entitlement under the IPRC Act.

Omit victim's address

Neither the victim's name nor address is to be included in the report.

The victim's name and address must, however, be provided separately to the Courts Fines Section if reparation is to be paid.
