Introduction

This part outlines the process of creating the appendix for sentences of home detention (HD), community detention (CD), and residential restrictions (RR) as part of parole.

The appendix will be used to present key information to the court or New Zealand Parole Board (NZPB) for their use when considering sentences of HD/CD/RR.

The appendix is a stand alone document that is attached to one or more of the following documents:

  • full pre-sentence report
  • parole assessment report
  • application to court or NZPB for variation in offender address
  • HD re-sentencing report, and
  • on-strength court report.

Note: The appendix can also be attached to on-strength court reports accompanying breach, variation or review applications that canvass sentences of HD and CD, and conditions of RR in a parole order.

Legislative reference: Section 26A Sentencing Act, and section 34 Parole Act 2002.
