The NZPB will schedule a hearing for approximately two months after receiving the ES special conditions application and reports. The hearing will take place at the offender's prison or the prison nearest the offender's address. The ES coordinator will notify the probation officer of the date and location of the hearing.

Attendance at NZPB hearing

A probation officer is required to attend the hearing.

The probation officer managing the offender or allocated to manage the offender should attend. If this is not the probation officer who wrote the ES Special Conditions report, the attending probation officer should ensure they are familiar with the report and the rationale for the proposed special conditions before attending the hearing.

Preparing for the NZPB hearing

Before the NZPB hearing, the attending probation officer should:

  • check that the address or proposed address is still current. If the offender has moved and it is possible that this will result in the offender not attending the NZPB hearing, the probation officer must advise the board administrator immediately of the new address.
  • check on compliance with any current release or ES conditions.
  • check date of commencement and length of any required programme/treatment.
  • be familiar with the offender's risks and the rationale for the special conditions.

Victim notification

It is the NZPB's responsibility to notify:

  • any registered victims of the hearing and special conditions imposed, and
  • the victim notification coordinator of any issues in relation to the victim resulting from the imposition of special conditions.

Documentation of special conditions

When the parole board set the ES special conditions, they issue a document in the form of a letter setting out the special conditions. This is generated by the NZPB, not the prison or CPPS. Copies are sent to the offender and to the relevant service centre.
