This topic covers the criteria and process to follow for recommending person to person (PTP) special conditions.

PTP monitoring is an intensive and restrictive regime involving the offender being subject to residential restrictions conditions and accompanied by one or more supervisors. This may either be for 24 hours a day or only during approved absences from the residence. PTP monitoring can only be imposed for up to the first 12 months of the ES order.

Criteria for PTP

To be eligible for PTP monitoring, an offender must first meet  the criteria for imposing EM.

PTP monitoring can only be imposed in conjunction with residential restrictions conditions.

To be suitable for PTP, the offender must meet a number of the following criteria, but it is not necessary for all criteria to be met:

  • be very high risk of re-offending
  • be reliant on others to monitor behaviour to avoid re-offending
  • have poor coping skills
  • exhibit impulsive behaviours or low self-control
  • lack insight into effects of their own behaviour on others
  • be unable to learn and retain information
  • have a low IQ
  • have difficulty in relating to adults
  • displayed sexual behaviours from an early age
  • have emotional basis to offending
  • offend after minimal grooming of victims, or
  • convicted within a short time of release.

Note: PTP monitoring will be appropriate only for a very few most high-risk offenders.

Process for PTP

The process for seeking approval and writing the special conditions report for PTP monitoring is set out below. This process should occur in conjunction with seeking approval for EM conditions set out in the previous topic.

If the probation officer is considering PTP, then the probation officer advises the ES operations adviser before writing the draft ES report.

If, after discussion with ES operations adviser, the probation officer is still considering PTP, the probation officer discusses this with the service manager.

The service manager writes a memo to the area manager:

  • setting out how the offender meets the PTP criteria, and
  • seeking approval for PTP.

If the area manager supports the recommendation, then the area manager:

  • identifies and costs a service provider for the person to person supervision, and
  • includes these details in the memo.

The area manager forwards the memo to the regional manager, noting whether they support the recommendation for PTP.

The regional manager forwards the memo to the ES operations adviser, noting whether they support the recommendation for PTP.

The ES operations adviser:

  • checks the PTP proposal against the available budget
  • refers the proposal to the area manager for revision if necessary, then
  • forwards it to the assistant general manager, CPPS, for budget approval.

Once the assistant general manager, CPPS, has approved the PTP budget, the ES operations adviser forwards the proposal to the general manager, CPPS.

The general manager, CPPS, either approves PTP or not and conveys the decision to the probation officer via line managers.

The probation officer writes the ES report as per usual process. This includes submitting the draft report to the ES operations adviser for feedback.

  • If PTP was approved, then include in the report:
    • how the offender meets the PTP criteria
    • how PTP will mitigate risk of re-offending
    • the details of the PTP service provider
    • how the offender's personal circumstances will be managed on a daily basis
    • the hours of PTP monitoring
    • the provider's ability to provide provisions for structured activities, and
    • plans for reduction of PTP over the first year (if considered appropriate).
  • If PTP was not approved, then note in the report that PTP was considered but was not deemed appropriate and briefly state why.

When the final report is received at the CPPS head office, the ES coordinator will submit it to the general manager, CPPS, along with a cover memo for the general manager, CPPS, to approve the report's recommendations.
