  • specific
  • enforceable, and
  • realistic.

Recommended wording for ES special conditions is provided below.

Accommodation and whereabouts

Recommended wording of special conditions for accommodation and whereabouts:

  • To reside at <address> and not to move address without the prior written approval of a probation officer.
  • To reside at an address approved in writing by a probation officer and not to move address without the prior written approval of a probation officer.
  • Not to stay away overnight from your residence without prior written approval of a probation officer.
  • Not to approach, enter or remain at <place or premises of speciffied named person> or any other <name or specific type of place> at all times as specified by your probation officer.

Employment

Recommended wording of special conditions for employment:

  • To engage in only such vocational training/employment (paid or unpaid) as approved in writing by the probation officer.

Computer and internet access

Recommended wording of special conditions for computer and internet access:

  • Not to possess or use any computers or electronic equipment capable of accessing the internet.
  • Not to possess or use any computers or electronic equipment capable of accessing the internet unless under the direct supervision of an informed adult who has the prior written approval of your probation officer. An informed adult is a person over the age of 20 years who is fully aware of your previous offending and high risk situations, and in the opinion of the probation officer will not support or collude with any further offending.
  • To make available to any probation officer and/or his/her agent any computer or electronic equipment in your possession or control for the purposes of checking and monitoring your use of any computer or electronic equipment to ensure compliance with the previous condition.

Victim issues

Conditions prohibiting contact with children under 16 and victims without the prior written approval of the probation officer are contained in the ES standard conditions.

Programmes/treatment

Recommended wording of special conditions for programmes/treatment:

  • Attend, participate in, and adhere to the rules of a <specify programme, e.g. STOP, SAFE, alcohol/drug programme> to the satisfaction of your probation officer and the programme facilitator(s).
  • Attend <specify number> sessions with a Department of Corrections psychologist to complete the current treatment, at times and dates as may be directed by the probation officer in consultation with the psychologist.
  • Attend scheduled appointments with a Department of Corrections psychologist, at times and dates as may be directed by the probation officer in consultation with the psychologist.
  • Undertake up to four sessions with a Department of Corrections psychologist in order to update a safety plan, at times and dates as may be directed by the probation officer in consultation with the psychologist.
  • Undertake any psychiatric treatment at times and dates as may be directed by the probation officer in consultation with the psychiatrist.
  • Take the following prescription medication for <name of medication> as prescribed by <name of person prescribing medication> in accordance with any directions given by <name of person prescribing medication> in accordance with any directions given by <name of person prescribing medication >

Relapse prevention or maintenance group

Recommended wording of special conditions for relapse prevention or maintenance group:

  • Attend, participate in and adhere to the rules of a <specify relapse prevention group > to the satisfaction of the probation officer and group facilitator(s).
  • Attend, participate in, and adhere to the rules of a <SPECIFY group prevention relapse> to the satisfaction of the probation officer and group facilitator(s).
  • Upon agreement with the whanau/family, attend a whanau/family hui at an approved venue within a timeframe to be determined by your probation officer.

Residential Restrictions

Recommended wording of special conditions for residential restrictions:

24 hour residential restrictions

  • To remain at <address> at all times and comply with all the requirements of the special condition of residential restrictions for <specify period>.

Less than 24 hour residential restrictions

  • To remain at <address> during the hours of <day and time> and comply with all the requirements of the special condition of residential restrictions for <specify period>.

EM restrictions

Recommended wording of special conditions for EM restrictions:

Electronically-monitored restrictions on whereabouts

  • Not to enter or remain at <specified places> during the hours of  <day and time > (section 15 Parole Act 2002).
  • To comply with the requirements of electronic monitoring, as directed by a probation officer.

Note: This wording is not pre-entered into IOMS and will need to be entered in full.

PTP monitoring

Recommended wording of special conditions for PTP monitoring:

  • To submit to be accompanied and monitored 24 hours a day by an individual or individuals, approved by a person authorised by the chief executive of the Department of Corrections to undertake PTP monitoring, for a period of twelve months from the commencement of this order.
  • To submit to be accompanied and monitored by an individual or individuals, approved by a person authorised by the chief executive of the Department of Corrections to undertake PTP monitoring, at any time you are absent from the residence, for a period of twelve months from the commencement of this order.
