Introduction

This topic outlines the tasks that must be completed in addition to the initial induction when an offender sentenced to CD first reports in.

Timeframe

The offender must report in to a probation officer (or a senior community work supervisor who has probation officer delegations) within 24 hours of being sentenced to CD.

Exception: If the 24 hours elapse on a weekend or public holiday, then the offender must report in to a probation officer on the next working day.

Legislative reference: Section 69E (b) Sentencing Act 2002.

Who to report to

The offender will generally report to a probation officer at the first report in. This is often a probation officer carrying out "duty officer" functions.

Notes:

  • If the offender is also subject to supervision or intensive supervision, then, where possible, they will report in to their supervising probation officer.
  • If the offender is only subject to CD, or CD and community work, then the offender may report to a senior community work supervisor who has probation officer delegations. If the senior community work supervisor has any doubts about how to deal with information provided during the initial induction, these must be discussed immediately with a senior probation officer or service manager.
Steps to take

The following table outlines the steps that must be undertaken at the first report in for all offenders sentenced to CD.

Confirm the offender's identity and gather offender's details (e.g. address, contact phone number, emergency contact person, etc).

Carry out the initial induction.

Determine if there are any issues that will need to be taken into account when managing the offender's CD (e.g. health issues, dog on property). Record any issues identified in IOMS casenotes.

Check the available EM installation time(s) provided by the senior community work supervisor.

Establish whether the offender has any commitments (e.g. work, childcare commitments) that will impact on their availability for the EM installation at the time proposed. If the proposed times are not suitable, liaise with the allocated senior community work supervisor to identify an appropriate alternative time.

Issue an instruction to report (ITR) at the curfew address for EM installation (see below for details).

Issue the offender with the CD Information booklet and advise the offender to:

  • go through this prior to the scheduled installation, and
  • note any questions they may have.

Note: Questions can be answered during the EM installation.

Explain who will be meeting the offender at the curfew address to carry out the EM installation.

Advise the relevant senior community work supervisor that the installation time has been confirmed.



EM installation ITR

The ITR issued to the offender for EM installation must outline the following:

  • the date and time of the installation
  • the curfew address where the installation will take place, and
  • the name of the senior community work supervisor who will be completing the installation.
