Introduction

This topic outlines the procedure for inducting an offender into any sentence, including community detention, at their initial report.

Steps to take

Follow these steps using the CD6 Induction Checklist when the offender reports within the timeframes of their sentence/release.

  • Establish the identity of the offender, and
  • confirm that he or she is the person named on the order/licence.

Check that there are no literacy or communication problems that may make the induction interview difficult for the offender. If such problems are found, it may be necessary to terminate the interview and reschedule with appropriate support.

Explain the purpose of the interview.

Using the serving time in the community booklet, explain:

  • the boundaries of confidentiality
  • information sharing between agencies, and
  • the offender's rights and responsibilities.

  • Confirm the offender's details:
    • name
    • address
    • telephone numbers
    • ethnicity
    • date of birth
    • place of birth
    • employment, and
    • contact details of significant other(s), and
  • update any changes in IOMS under offender details.

Confirm that the offender has a copy of the order/licence.

If not, refer to the CPPS copy and ensure the offender leaves with a photocopy of the order/licence.

  • Explain the requirements of the licence, and
  • outline the consequences of non-compliance.

Notes:

  • If the offender is subject to more than one sentence, ensure the offender understands the requirements of the standard and special conditions of each sentence.
  • Standard conditions vary between sentences.

If there is no order/licence, check that the offender has a copy of the court order/licence. If not, check:

  • the details of sentencing with the offender
  • for any other active, concurrent or cumulative sentences
  • IOMS for sentence details
  • if a copy of the court order/licence is held in the office, and
  • with the court that the order was served. If not, arrange for the order to be served.

Undertake the safety screening questions, or review the offender's answers to earlier safety screening questions.

If any safety concerns are highlighted, consult with the service manager and consider referral for a specialist safety assessment or to agencies in the community.

If the offender identifies any reintegrative needs that need immediate attention, take appropriate action to address them. These may include:

  • accommodation
  • access to a bank account
  • access to a benefit, and/or
  • victim issues.

Take the next steps in accordance with:

  • the first report in additional tasks for community detention outlined in the following chapter, and
  • the specific sentence/order induction if the offender is also subject to another sentence.


Explain to the offender

Issues to be explained to the offender include:

  • the consequences of disclosing further offending
  • who we share information with, and under what circumstances
  • how we monitor response to special conditions - in particular treatment and counselling
  • limits to privacy during home visits, and
  • their rights to access any information CPPS may have on file about them.

Note: For home detention (HD) or residential restrictions (RR) on parole, initial induction will occur at the offender's address.

Ongoing barriers to participation

It may be necessary to terminate and reschedule the interview if the offender is unable to participate in the induction interview because the offender:

  • has a language barrier
  • has a disability, or
  • has any other communication barrier that prevents them from:
    • understanding the induction information, or
    • completing the induction procedures.

Issue the offender with an ITR to report at a later date and record in the offender's case notes why the induction interview was terminated.

Take any necessary action to ensure that the interview can be completed successfully at that later date. Examples could include finding an interpreter, or support person, who can attend the rescheduled interview.

Temporary barriers to participation

It may be necessary to terminate and reschedule an interview because the offender is:

  • under the influence of alcohol or other drugs, or
  • in an emotional state.

If an offender is in an extremely emotional state:

  • assess risk of harm (see next topic) and refer to specialised services as appropriate
  • issue the offender with an ITR to report at a later date, and
  • record in IOMS casenotes why the interview was terminated.
