Introduction

This topic outlines the reporting and home visit requirements for offenders subject to community detention (CD).

Minimum contact principle

CPPS staff should have the minimum contact possible with offenders who are subject to CD only.

This is because CD is designed to be a monitoring sentence only; there is no allowance or intention for CPPS staff to provide any sort of routine rehabilitative or reintegrative intervention or assistance.

Reporting requirements

Offenders subject to CD are not required to report on a regular basis for the purposes of CD.

Offenders may be required to report for the following reasons in relation to their community detention. To:

  • complete partial induction
  • have electronic monitoring (EM) equipment temporarily removed
  • discuss changes in the offender's circumstances, and
  • discuss issues of non-compliance.

The following table outlines who the offender will report to.

If the offender is subject to... then the offender will report to the...
CD, or CD and community work (CW), a fine and/or reparation senior community work supervisor.
CD together with supervision or intensive supervision supervising probation officer.


Home visit requirements

senior community work supervisors are responsible for carrying out home visits for the purpose of CD.

Senior community work supervisors are not required to carry out home visits for offenders subject to CD on a regular basis.

Home visits may need to be carried out for the following reasons. To:

  • install, de-install and recover EM equipment
  • carry out CD induction, and
  • respond to EM equipment faults and tampers.
Record-keeping

If an offender subject to CD is required to report, then a written instruction to report (ITR) should be generated through IOMS and issued to the offender.

If a verbal ITR is issued, this should be recorded in IOMS casenotes.

Failure to report

If the offender fails to report as directed, the probation officer or senior community work supervisor must:

  • clearly document the offender's failure to report as directed in IOMS casenotes, and
  • carry out the appropriate enforcement action.
