Introduction

This topic outlines the process for approving an absence for an offender who is subject to CD.

Steps to take

The following table comprises the steps to take to approve an absence for an offender who is subject to CD.

Receive request for absence from offender, including required information.

Reference: This chapter, the topic General Requirements for Approved Absences, for details of the required information.

If the request for an absence is made on humanitarian grounds, determine whether the criteria for humanitarian absences are met. If a senior community work supervisor, this should be done in consultation with a probation officer or the service manager.

If the criteria are... then...
met go to step 3.
not met
  • decline the request
  • advise the offender of the reason why, and
  • advise the offender that they may make an application to the court to have their curfew period varied.


If the request for an absence is made (on other than humanitarian grounds) by an offender who is also subject to supervision or intensive supervision, determine whether the request meets the criteria for employment/training, rehabilitation, or restorative justice.

If the criteria are... then...
met go to step 3.
not met
  • decline the request
  • advise the offender of the reason why, and
  • advise the offender that they may make an application to the court to have their curfew period varied.

Determine whether the request is in line with the guiding principles for approving absences.

If the request is... then...
in line with the guiding principles go to step 4.
not in line with the guiding principles

either:

  • decline the request, or
  • seek service manager approval.

Determine whether the request requires service manager approval. Service manager approval is required for all absences on humanitarian grounds.

If the request...  then...

does not require service manager approval

go to step 6.

does require service manager approval

go to step 5.

Determine whether the service manager approves.

If the service manager... then...
approves go to step 6.
does not approve
  • decline the request
  • advise the offender of the reason why, and
  • advise the offender that they may make an application to the court to have their curfew period varied.

Approve the absence and fill out the ‘Direction Notice for Approved Absences’.

If the offender is...  then...
present go to step 7.
not present

direct the offender to report to collect the ‘Direction Notice for Approved Absences’.



Note: If the absence requires approval from the service manager and this is given, then the service manager must sign the Direction Notice for Approved Absences.

Issue the offender with the Direction Notice for Approved Absences.

Remind the offender that they must carry their CD order and Direction Notice for Approved Absences while on the absence.

Record the following points in IOMS casenotes:

  • the request for an approved absence
  • whether the request was approved or denied
  • reasons for the decision
  • if approved, how the approved absence will be monitored or confirmed
  • the date, time, location and purpose of the approved absence, and
  • confirmation from EM records that the offender was absent only at the approved times.

Keep a copy of the completed Direction Notice for Approved Absences on the offender’s file.
