Probation officer may approve an alternative curfew address

If an application for variation or cancellation is made on the grounds that:

  • the curfew address is no longer available or suitable because of a change in circumstances, or
  • such an application is intended,

then the probation officer may approve an alternative curfew address until the application is determined.

If an alternative curfew address is approved before an application for variation or cancellation is made, then the probation officer must make an application within five days of approving the alternative address (unless the offender has made such an application in that time period).

Legislative reference: Section 69K Sentencing Act 2002.

CPPS policy

Approval of an alternative address should only be given if the offender:

  • cannot remain at the current curfew address during the curfew period, and
  • must move urgently.
Service manager approval

Staff must consult with the service manager and seek their approval before moving an offender to temporary accommodation.
