Introduction

To ensure accuracy of orders for release on conditions, each order must be checked against the copy of the warrant of imprisonment.

This topic deals with rectifying the following situations:

  • incorrect dates or no entry in IOMS
  • conditions not imposed/supervision past expiry date
  • no licences/order in IOMS
  • cumulative community-based sentences.

Note: Enforcement action is not to be taken on any order for release on conditions without first obtaining a copy of the warrant of imprisonment to ascertain the validity of the sentence and conditions.

Incorrect dates/order

The IOMS helpdesk is to be notified in all instances:

  • where there is an incorrect order entered, or
  • the start and end dates are wrong.
Entry of orders

If an order for release on conditions is not in IOMS or the start/end dates are incorrect then ask the receiving office to enter/rectify the entry.

Note: If an order is not entered in IOMS, manage the offender by making notes via the offender header.

Conditions not imposed/ past expiry date

If notified that release on conditions was not imposed on an offender, or if the offender has been supervised past the sentence expiry date:

  • meet with the offender in person and advise them of the situation
  • case note the meeting, including their response, and
  • terminate the sentence and case note the reasons.

Note: If the offender expresses concerns, refer them to the usual complaints procedure. If further action is necessary:

  • consult with the service manager, or
  • ring the CPPS operations help desk.

Licence/order not available in IOMS

If an offender reports saying they are subject to release on conditions but a release licence has not been issued and/or there is no order entered in IOMS:

Contact the receiving office of the relevant prison to:

  • request a copy of the warrant of imprisonment, and
  • if the offender is subject to an order, then request:
    • a release licence, and
    • that the order is updated/entered in IOMS.
