Recall Application  

The recall application sets out the actual application and the grounds for the recall application. It must have a coversheet.

The recall application and coversheet must be created using the MS Word recall application template.

Note: no further information should be added to the document once it has been created from the template. This is because the format and content of the application is set by the Parole Act Regulations.

The following table outlines the information that must be included in the recall application.

Information Type include:
offender’s details
  • full name
  • current or last known address
  • occupation, if known
sentence details 
  • sentence length
  • offence(s)
  • details of any linked cumulative sentence
release details
  • prison released from
  • date of release
grounds for recall
  • grounds as per section 61 of the Parole Act 2002
reference to the attached affidavit
  • the date the affidavit was sworn/affirmed
  • where the affidavit was sworn/affirmed

Affidavit 

The affidavit provides the evidence to support the recall application.

It must:

  • be specific and factual,
  • accurate,
  • state details of actual behaviour or incidents, and
  • tell the reader the “full story” not just information about the recall.

Statements such as ‘reported intermittently’ or ‘on a number of occasions’ are not sufficiently specific.

Note: The affidavit must be sworn/affirmed in front of a registrar or JP.

The affidavit is also created using the MS word recall application template.

Note: additional information will always need to be entered in the document created by the template. The prompts provided in the affidavit should be used to ensure that all necessary information is included.

The following table outlines the information that must be included in the affidavit.

Information type include:
applicant's details
  • applicant's full name
  • city of residence
  • occupation
offender's details
  • full name
sentence details
  • sentence length
  • sentencing court
  • sentencing date
  • offence(s)
  • details of any linked cumulative prison sentences
  • sentence expiry date
  • the criminal and traffic conviction history referenced and attached as an exhibit
release details
  • release type ie parole or compassionate release
  • prison released from
  • release date
  • length of parole conditions (including commencement date and end date)
  • special conditions imposed
  • the release licence referenced and attached as an exhibit
reporting details
  • the reporting frequency
  • date offender last reported
  • offender’s compliance with reporting requirements
overview of offender’s response to parole 
  • their compliance with standard and special conditions
  • progress made towards addressing specific special conditions
  • any positive comments, where applicable
  • supporting evidence referenced and attached as an exhibit
clear, accurate and detailed description of the ground(s) for recall 
  • how the ground(s) for recall are met
  • specific behaviour and actions that are relevant
  • supporting evidence referenced and attached as exhibit(s)
clear, accurate and detailed description of the grounds for interim recall (if applicable) 
  • how the ground(s) for interim recall are met
  • specific behaviour and actions that are relevant
  • supporting evidence referenced and attached as exhibit(s)
any other relevant concerns 
  • information about offending or likelihood of re-offending
  • safety and risk issues
conclusion statement 
  • a brief summary of the evidence, the  grounds for recall, and how they are met
 
Supporting documents 

Supporting documents include:

  • any supporting evidence/exhibits referred to in the affidavit
  • any other relevant affidavits (e.g. from police, witnesses, etc)

All supporting documents referred to in the affidavit must be labelled and attached to the affidavit. These are labelled alphabetically in the order they are referred to in the affidavit.

Examples of supporting evidence and exhibits include:

  • release licence
  • criminal conviction history
  • active charges list
  • police summary of facts
  • proof of conviction (if available)
  • written instructions/ ITRs
  • affidavits or statements from the police/other witnesses
  • reports from programmes providers, etc.
Fax coversheet 

The fax coversheet provides the NZPB with essential information about the offender, and contact details for CPPS.

It is created using the MS Word recall application template.

Note: additional information will always need to be entered into the document created from the template.
