Introduction 

Following the service of affidavit to an offender on an indeterminate sentence, the crown solicitor provides notification of the hearing and reports progress.

Notification of hearing 

The crown solicitor advises the operations advisor at CPPS head office and the supervising probation officer of the place, date, and time of the recall application hearing.

The crown solicitor also:

  • advises whether a probation officer’s presence is required at the hearing
  • liaises with CPPS regarding witnesses required to attend the hearing.
Reporting progress 

The crown solicitor provides CPPS with a report after any significant event in the progress of the matter to resolution. Upon final disposition of the recall hearing, the crown solicitor provides as soon as possible after disposition a:

  • report to CPPS, including any matters of importance to other files or possible appeal
  • written copy of the decision.

Note: The operations advisor passes a copy to the probation officer.
