Process 

The following table describes the process for managing a recall application once:

  • it has been lodged with the NZPB,
  • the grounds for interim recall are met, and
  • the panel convenor or chairperson orders an interim recall.
Task Description
NZPB Administrator
1
  • Receives the application and:
  • checks whether the application has been signed
  • checks that the exhibits match those noted in the affidavit
Panel convenor/chairperson

  • Considers the application
  • If appropriate, makes an interim recall order.
  • Signs the warrant for return to prison.
  • Returns the paperwork to the NZPB administrator.
NZPB Administrator

  • Completes the warrant for return to prison
  • Sends the completed recall application and warrant for return to prison to the panel convenor or chairperson for consideration.
  • Checks IOMS to determine whether the offender is currently held in custody
  • If the offender is not in custody:
    - scans in the warrant and coversheet
    - emails the warrant and coversheet to the police.
Police

  • Receive the warrant and coversheet from NZPB and:
  • logs the warrant on the Police system
  • allocates a unique job number to the warrant
  • sends an email notification to the NZPB, with the job number
  • dispatches the job to the appropriate unit to arrest the offender.

5 Notifies the originating probation officer and the prison receiving office of the signed warrant and police job number. 
Probation Officer
6 Liaises with local police, using the job number, to help facilitate the offender’s arrest.
7 Updates IOMS and the recall application tab

8 Arrest the offender
Prison Services (PS) staff member
9 Notifies the NZPB administrator of the date/time the offender was taken into custody.
NZPB Administrator
10 Schedules the hearing and faxes a copy of the application and notice to the appropriate receiving officer and probation officer.
PS staff member
11 As soon as practicable after the offender has been taken into custody, and following the issue of the warrant:
serves a copy of the recall application and notice of hearing on the offender
faxes or emails confirmation of service to the NZPB administrator.
 
Next steps 

After the recall application is lodged, the next steps are to:

  • confirm the scheduled NZPB hearing
  • notify the relevant parties of the pending hearing
  • prepare for the hearing
