Without special condition

The following table outlines the actions to be taken when the address is no longer available, and the offender is subject to the following with no special condition relating to RR:

  • parole
  • release on conditions
  • post conditions
  • supervision, or
  • intensive supervision.

If the address is no longer available, and …

then the probation officer should …

the offender is unable to provide an alternative address immediately
  • advise the service manager
  • provide assistance/support for the offender to work with appropriate agencies to establish an alternative address, and
  • issue an instruction to report (ITR) to increase reporting frequency of offender until the accommodation issue has been resolved (with frequency to be determined by the level of risk posed by the offender).
no alternative address can be provided within seven days

 discuss with service manager/senior probation officer, and consider whether it is necessary to:

  • make an application to the NZPB for recall (if the offender is on parole and subject to recall), or
  • make an application to the court to cancel and substitute the sentence (if the offender is on a community-based sentence).
an alternative address is provided follow the procedure for change of address.

With special conditions

  • the offender is subject to:
    • parole (without RR)
    • release on conditions
    • post detention conditions
    • supervision, or
    • intensive supervision, and
  • has a special condition which requires them to live at a special address, or an address approved by the probation officer.

If the address is no longer available, and...

then the probation officer should ...

the offender is unable to provide an alternative address
  • advise the service manager
  • provide assistance/support for the offender to work with appropriate agencies to establish an alternative address, and
  • issue an ITR to increase the reporting frequency of the offender until the accommodation issue has been resolved (with frequency to be determined by the level of risk posed by the offender).
no alternative address can be provided and approved within seven days discuss with service manager/senior probation officer, and consider whether it is necessary to:

  • make an application to the court to substitute the sentence (if the offender is on a community-based sentence).

  • discuss with the service manager/senior probation officer, and
  • consider taking enforcement action
