Introduction

This topic provides information and procedures for refusing the transfer request.

Reasons for refusal

The transfer may be refused because:

  • there is an outstanding breach
  • there are unresolved victim issues
  • the proposed address is considered unsuitable, or
  • special conditions of the sentence/order prohibit the offender from transferring e.g. programme not available in new area.
Procedure for refusing a transfer

Note: An area manager must approve any decision not to transfer an offender because the service centres are unable to reach agreement about resolution of outstanding breach action.

If offender moves in spite of refusal

If a transfer is refused and the offender moves residence and attempts to report to another service centre anyway, this is a breach of the sentence/order. The supervising probation officer in the originating service centre must take enforcement action.
