Introduction

When considering the appropriate action to take in response to the new charges, the probation officer should refer to the enforcement guidelines.

Note: Breach action cannot be taken in response to further charges unless the offending is a breach of an absence for an offender on HD.

Consider regression

It may be appropriate to bring the offender back on to the previous phase to increase the reporting frequency and monitoring of the sentence/order.

Rehabilitative intervention

If the offender had completed a rehabilitative intervention, such as alcohol and drug counselling at the time of the new charges, and the probation officer establishes that substance abuse was linked to the new offending, the offender should be referred back to the service provider for further assessment/counselling.

Offender recall application to NZPB

If the offender is on parole and eligible for recall, an application must be made to the NZPB.

Note: The probation officer should not wait for the result of the charges before making the application.

Service manager oversight

If the probation officer is uncertain as to the appropriate course of action to take in response to the new charges, this should be discussed with the service manager or senior probation officer.
