Introduction

Breach action involves laying a charge against the offender for breach of the conditions of the sentence/order. If the offender is found guilty, this results in a separate conviction and possible further sentence.

This chapter covers the guidelines and procedures for breach action.

This chapter contains the following topics:

  • About Breach Action
  • Penalties for Breaching a Sentence/Order
  • Breach Process
  • Preparing Paperwork for Breach Action
  • Laying a Breach Charge
  • Preparing File for Prosecution of Not Guilty Hearings
