Steps to take

Follow these steps to prepare the paperwork and update IOMS for a breach action.

Obtain all relevant information regarding the breach from any staff.

Note: This is important evidence should the offender plead not guilty.

  • Complete the checklist provided, and
  • obtain the service manager's signature on it for the intended action.

Create a breach file and prepare the following breach documents:

  • information
  • summary of facts, and
  • letter to court for warrant (if appropriate).

Notes:

  • Enter the relevant details in the IOMS "breach" tab. If there is more than one breach, use a separate information form for each breach.
  • A service manager is to check the breach before proceeding past this point.

Following completion of the "breach" tab in IOMS, transmit the information to court to generate a court record number (CRN).

Print a copy of an up-to-date previous convictions list.

Update IOMS casenotes.

File the summary of facts and all information relevant to prosecuting the breach in the breach file ready for the hearing.



Summary of facts

The summary of facts should contain details of:

  • the original conviction(s) and sentence (including sentence end date)
  • when the offender was instructed to report (if applicable)
  • date, time and information supporting the allegation that an offence was committed
  • any explanation or excuse provided by the offender for the alleged offence
  • actions taken by the probation officer to get the offender to comply (if applicable)
  • amount of reparation sought for the loss of/damage to any electronic monitoring equipment.
