Introduction

This chapter provides information about the processes of having offenders arrested and managing warrants to arrest (WTA).

Once an offender is arrested, they will be held in custody until the first available appearance before a court.

Warrants to arrest

A warrant to arrest an offender can be requested by Community Probation & Psychological Services (CPPS) when:

  • an offender fails to appear in court, or
  • a probation officer is unable to serve a summons for a court appearance on an offender.
Arrest without warrant

In some cases the legislation explicitly allows for offenders to be arrested without warrant. This enables a probation officer or a member of the police to arrest an offender and have them held in custody, awaiting a court appearance.
