Probation officer may suspend conditions

For any application seeking remission, suspension or variation of special conditions, the probation officer may suspend any conditions to which the application is related until the application is determined.

Check with service manager

Suspending conditions is not a decision that should be made lightly. Discuss with your service manager the appropriateness of suspending any conditions prior to a hearing.

Details of the suspended condition(s) and the reasons for the suspension must be clearly documented.

Temporary address (HD)

If the probation officer approves a temporary address for an offender on HD (under section 80H Sentencing Act 2002), the applications to the court must be submitted within 5 working days.

Timeframes for suspension of conditions

For all other conditions, the probation officer can only suspend conditions after laying the application in court and until the hearing. At the hearing the court will decide the application.
