Agency responsibilities

The agency responsibilities are to:

  • provide appropriate work and supervision for offenders placed with them
  • provide access to toilet facilities and drinking water
  • inform the offender of their rules
  • comply with the health and safety regulations and advise the supervising probation officer of any accident or injury immediately
  • return a daily attendance report on a weekly basis (whether the offender has attended or not)
  • advise the probation officer (or delegated officer) immediately of any non-approved absences, incidents or other problems, and
  • allow community probation staff access to the offender whilst placed with them.

These above matters are outlined and covered in the community work agreement to be signed by the probation officer and agency.

Note: The community work agreement is not to be signed by the offender.

Remuneration

The offender and the agency must be reminded that the law forbids the offender from accepting any gift or remuneration for their work.

Steps to take

Follow the steps below to hold the meeting with the CWA and offender.

Meet with the offender and the CWA.

Discuss the following with the offender and the CWA's designated representative:

  • work to be undertaken by the offender
  • the offender's reporting requirements, and
  • the supervision to be provided by the agency.

Induct the offender into their CWA placement by:

  • confirming the offender's placement, and
  • confirming the:
    • days/hours for reporting
    • type of work to be undertaken
    • process for notification of hours and performance
    • name of the offender's CWA supervisor, and/or contact person
    • rules or requirements specific to the agency
    • health and safety requirements
    • process for notification of absence
    • process for notification of incidents, responsibilities
    • general "housekeeping" rules of the agency
    • rules regarding meal breaks, leaving the agency during the work period, telephone calls
    • roles and responsibilities of the offender, probation officer and agency, and
    • complaints procedure.

Note: The offender's consent is not required; however, good practice should involve the offender in the discussion for reporting times and the work to be undertaken.

Confirm with the CWA and the offender their understanding of their:

  • rights
  • roles, and
  • responsibilities.

Issue the offender with the CW ITR.

Note:  The CW ITR must be re-issued whenever the reporting times or frequency changes

  • Complete the community work agreement with the agency, and
  • provide a copy to the agency.
