Introduction

This topic covers actions to take when an agency placement breaks down.

Offender fails to comply

If an offender is failing to comply with the requirements of the sentence, and initial steps to address non-compliance have been taken, then take the following actions.

Offender

Instruct the offender to report to a community work centre (CWC) to continue serving their sentence.

Agency

  • Thank the agency for their involvement
  • advise them of what action has been taken, and
  • check whether they are still willing to be a CWA for other offenders.

Reference: Volume 3a, Part VI, Non-compliance and Enforcement. (please refer to the related links section on this page)

Agency unable to continue

If the agency is unable or unwilling to continue providing work either temporarily or permanently, then take the following actions:

Offender

  • All offenders placed with the agency should be assigned to another agency.
  • Inform the offenders of the reason for their removal and assure them that the hours worked have been recorded against their sentence.

Agency

  • Thank the agency for their involvement, and
  • if appropriate, invite the agency to contact Department of Corrections if they are willing to provide further work for offenders in the future.
