Further offending

If the offender appears in court on further offences, take the following steps.

Step Action

1

Advise the court officer of how many hours the offender has completed.

If a short sentence of imprisonment is likely to be imposed, advise whether the offender’s community work (CW) sentence should be:

  • suspended for the duration of the custodial sentence, or
  • suspended entirely.

Check with the court officer for the outcome of sentencing and use the table below to decide what to do.


If the offender is sentenced to… then…
CW
  • follow the process for setting up a concurrent or cumulative sentence
  • if the offender is with CWA placement, reassess the suitability of the placement in the light of subsequent offence and offending
  • re-assess the offender’s progress to meeting CW timeframes, and
  • if necessary, re-issue the instruction to report (ITR).
supervision or intensive supervision
  • liaise with the allocated probation officer, and
  • if necessary, adjust CW reporting hours to accommodate any programme requirements.
community detention (CD) or home detention (HD)
  • liaise with the allocated probation officer
  • review CW ITR in consultation with other CPPS staff, and
  • if necessary, adjust CW reporting hours to accommodate any curfew or other sentence requirements.
a sentence of imprisonment of not more than 12 months – CW suspended for duration of imprisonment
  • write to the offender in prison advising of the requirement to complete sentence on release
  • instruct offender to report within 72 hours of release, and
  • if the offender was with CWA placement, reassess the suitability of the placement in the light of subsequent offence and offending.

Note: The date for completion of the sentence is extended by the length of the time spent in prison.

a sentence of imprisonment of not more than 12 months and CW suspended

or

a sentence of imprisonment of more than 12 months

  • terminate the sentence.
