Introduction

This chapter covers procedures for managing a change of address when an offender is subject to community work (CW).

Legislative requirements

If an offender who is subject to a sentence of community work (CW) moves to a new residential address, the offender must notify the senior community work supervisor/probation officer of the details of the new address within 72 hours of moving.

The offender will be informed during induction of this requirement, and that enforcement action may be taken if this requirement is not complied with.

There is no legislative requirement for an offender to advise CPPS prior to or have CPPS approve a request to move to another address. It is CPPS policy to request the offender advise CPPS prior to moving to an address in a different community work centre (CWC) area to allow for the transfer of information between service centres.

Managing a change of address (joint sentences)

If the offender has dual sentences, the staff member managing the other sentence is responsible for managing the change of address. This is because the standard and special conditions on other sentences and orders may require the offender to obtain the permission of a probation officer before moving to another address.

If the senior community work supervisor/probation officer is advised of a change of address by an offender on a joint sentence, they must immediately notify the staff member managing the other sentence(s).

Enforcement

If the offender fails to advise the senior community work supervisor/probation officer within 72 hours of moving to a new residential address, and is unable to provide a reasonable excuse for failing to do so, then consider enforcement action.

All details regarding whether enforcement action is to be undertaken, or not, should be recorded in IOMS casenotes.

Note: If the offender is subject to dual sentences, it is important to discuss any enforcement action with other probation officers/senior community work supervisor involved.
