Situations for not accepting the file

In some circumstances, the service manager at the receiving CWC may not accept the transfer of the file, but will have the offender continue to report to the service centre and undertake the CW hours.

Examples of when this action may be appropriate are:

  • the file is not in order, e.g. the order is incorrect, required documents are not on the file, IOMS records are not up to date
  • the offender has a poor record of compliance with the sentence
  • the supervising probation officer of a rehabilitative sentence has not approved the change of address
  • there is breach action outstanding, or
  • there are unresolved victim issues.

The reason for not accepting the transfer of the file should be:

  • conveyed to the service manager of the originating service centre by the service manager of the receiving service centre, and
  • noted in IOMS.

The originating service centre should attempt to resolve the issues impacting on the transfer of the file.

Note: The offender should still be allowed to continue with their CW hours at the new service centre.
