Introduction

This topic covers the procedure for transferring the responsibility for managing the sentence to another service centre.

This happens when an offender moves their place of residence out of the area, or CWC area, and the offender is subject only to a sentence of CW.

Must accept transfer

There is no legislative requirement for an offender to advise CPPS prior to, or have CPPS approve a request to, move to another address. This means that:

  • if an offender reports to another service centre to undertake their sentence after having moved to a new residential address, CPPS has no legal authority to decline the offender’s transfer to that centre, and
  • the service centre must accept the offender and provide the opportunity for the offender to continue to undertake their sentence hours, unless they have moved to an area where CW cannot be provided for them.

In this situation, a probation officer must advise the court of the change in circumstances and ask for the sentence to be reviewed.

Offender responsibilities

It is the offender’s responsibility to advise CPPS of the details of a new address within 72 hours of moving address. Failure to do so may result in enforcement action.

If offender advises prior to moving

If the offender advises the senior community work supervisor/

probation officer of the details of the new address prior to moving, then the following actions should be taken.

Step Action

Phone the service centre where the offender will transfer to and:

  • advise of the transfer of the offender
  • establish the correct details regarding the service centre’s address, senior community work supervisor/probation officer name, and
  • request an appropriate reporting time (should be within 72 hours of the time the offender has advised they will become resident in the new area).

  • Generate an instruction to report (ITR) in IOMS for the offender, and
  • provide the offender with details of the service centre address.

Record the following in IOMS:

  • a casenote detailing the transfer and contact with the receiving service centre, and
  • details of the offender’s new address.

Prepare the file for transfer.



If offender does not advise prior to moving

If the offender does not advise the senior community work supervisor/probation officer prior to moving to a new address, and reports to a new service centre to undertake their hours, then the following actions should be taken.

Step Action

The senior community work supervisor/probation officer should contact the originating service centre and:

  • advise of the transfer of the offender, and
  • request transfer of the file.

Generate an ITR in IOMS for the offender to report to:

  • CWC induction (if centre), and
  • senior community work supervisor/probation officer responsible for agency placements (if agency).

Record the following in IOMS:

  • a casenote detailing the offender’s transfer and contact with the originating CPPS office/service centre
  • details of the offender’s new address, and
  • details of any potential obligations around any other sentence.

If the offender reports to the new CWC and advises of the new address outside the 72 hour timeframe, the senior community work supervisor/probation officer from the original service centre is to be responsible for taking appropriate enforcement action.
