Introduction

Breach action involves laying a charge against the offender for breach of the conditions of the sentence/order. If the offender is found guilty, this results in a separate conviction and possible further sentence.

Breach action is taken in response to specific actions of non-compliance with the sentence/order. It should not be used for minor, first time incidents.

This chapter covers the guidelines and procedures for breach action.
