Enforcement Guidelines

Introduction

This chapter provides guidelines to assist the probation officer/senior community work supervisor with making decisions regarding the level of enforcement action to take in response to non-compliance.

The action taken following non-compliance has some level of discretion, but must reflect the provisions of the Sentencing Act 2002. Consideration should also be given to the guiding principles for non-compliance and enforcement. The non-compliance should be assessed in the context of the general level of compliance and level of risk presented by the individual offender.

Procedures relating to implementing different types of enforcement action are found in the earlier chapters.
