Procedure for dealing with cooperation issues

Follow the table below to deal with cooperation issues following an interview with the offender.

Note: If the recommendation is to cancel the BWLS ITR, a decision about whether the offender will be withdrawn from the programme or allowed to remain on the programme may also need to be made.

Is this the first incidence of a cooperation issue, or a minor incident?
  • If yes, go to step 2.
  • If no, go to step 5.
If it is the first incidence or a minor incident

  • note in IOMS casenotes that there was a minor departure from the cooperation requirements of the BWLS programme (and note the specifics of the issue), and
  • senior community work supervisor recommends to issue a warning to the offender, advising that any further instance of inadequate cooperation or any other departure from the terms of the BWLS programme will result in none of the BWLS hours being counted towards their CW hours.

The service manager reviews and approves (or amends) the recommendation to issue a warning.

The senior community work supervisor or probation officer should then:
  • issue a written warning to the offender, and
  • update IOMS casenotes and the offender’s hard copy file with the warning.
  • advise the provider/Work and Income of the outcome where appropriate.
If it is not the first incidence or is a major incident

The senior community work supervisor or probation officer recommends that:
  • the offender’s BWLS ITR is cancelled
  • none of the BWLS hours completed are counted towards their CW hours, and
  • the offender is either
    • withdrawn from the programme, or
    • allowed to continue to attend the programme.

The service manager reviews (or amends) the recommendations.

The senior community work supervisor or probation officer should then:
  • cancel the BWLS ITR
  • issue an updated CW ITR (where appropriate)
  • update IOMS casenotes to record the outcome and enter the details of any new ITR(s)
  • advise the offender (in writing) of the decision, and
  • inform the provider/Work and Income of the outcome where appropriate.

The senior community work supervisor or probation officer completes the end of programme steps as set out in Volume 3A, Part VIII, Chapter 5, End of Programme.
