Eligibility of offenders for SPM's

Introduction

This section covers the criteria for identifying offenders who are eligible for an SPM.

Eligibility for SPMs

An offender is eligible for a Support Planning Meeting if:

• convicted of sexual offence(s) against male or female children under 16 years of age, and
• subject to home detention, parole, release on conditions, supervision or extended supervision.

Eligible child sex offences are:

• offences specified in s107B of the Parole Act 2002 (external link).
• s131B Crimes Act 1961 (external link): Meeting young person under 16 following sexual grooming, etc.
• other sexual offences, eg:
• s124 Crimes Act 1961 (external link): Distribution or exhibition of indecent matter
• s125 Crimes Act 1961 (external link): Indecent act in public place
• s126 Crimes Act 1961 (external link): Indecent act with intent to insult or offend
• 135 Crimes Act 1961 (external link): Indecent assault
• 142A Crimes Act 1961 (external link): Compelling indecent act with animal

But only where the victim or intended victim was a child under 16 years of age.
