Legislative provisions to share information

The Department and the NZ Police share information about HRX offenders in accordance with: 

  • the Corrections Act 2004 s182,
  • the Official Information Act 1982,
  • principles 11(e)(i) and 11(f)(i) of the Privacy Act 1993
  • S.54 of the Parole Act.

Both parties will exchange information and use that information in keeping with the Privacy Act principles and maintain confidentiality.

Local agreements

Each prison and CPS site must have agreements in place with their local Police stations that detail:

  • procedures for requesting and recording information
  • methods of exchanging information (e.g. face-to-face, telephone, fax or other).

Information from PPS to CPS and the Police

PPS is responsible for ensuring the transfer of information as follows:

  • Advise the local CPS office that HRX offenders are to be released (either statutory release or as directed by the NZPB) and copy information to CPS Head Office Operations by emailing cps_ops_helpdesk. This must be done immediately, or as soon as practicable following a release directive from the NZPB.
  • For HRX offenders on Home Detention or release under subpart 2 of part 1 of the Parole Act 2002, provide the Police at National Office level with details of the offender's identity, recent photographs and details about new tattoos or tattoo removals, scars or deformities that occurred while the offender was in prison.

Information from CPS to the Police

The Relationship Manager from each CPS site is responsible for ensuring the transfer of information to the Police as follows.

Note: The Relationship Manager will be either the Service Manager or a Senior Probation Officer.

Inform the Police of… Timeframe
the release date (either statutory or as directed by the NZPB) and release conditions of an HRX offender (including offenders subject to HD). at least 5 working days before the release or immediately following the release directive from the NZPB.
any change to the offender's conditions as approved by NZPB, the Court, or where a Probation Officer has exercised their discretion under a release condition. This includes the residential address of the HRX offender

within 5 working days of the variation being approved.

breach action or application for alternative sentence lodged with the Court

within 5 working days of the application being lodged with the Court.

an interim and/or final recall granted by the New Zealand Parole Board within 5 working days of the recall being made.


 Information from Police to CPS

The Police Relationship Manager is responsible for ensuring the transfer of information to CPS. The following information will be transferred as soon as practicable:

  • Any law enforcement information that could assist with the proper and appropriate management of those offenders
  • Any Police involvement with those offenders (e.g. interviews, cautions etc.)
  • Any suspicion of further offending by those offenders, and
  • Details of any information about gang links/criminal associations.
