Who pays

Reasonable charges can be made for some requests for non-personal information under S.15 (1A) and 15(2) of the OIA.

Any decision to charge for information must be referred to the CPS Operations Help Desk at Head Office.

Note: An individual cannot be charged for personal information.

Rules for charging

In general, the following rules may be considered.

Reproduction of information

the first 20 pages of photocopying

Community Probation Service.

any further photocopying

the requester, at a rate of 20 cents per page.

Labour

the first hour of work

any subsequent time

the requester, at a rate of $38 per hour or part thereof.

  • extra time spent locating or retrieving information when it is not where it ought to be, or
  • time spent on deciding whether or not to release information and in what form

Advising the requester of charges

Where charges are to be sought:

  • advise the requester of the likely charges before the request is processed, and
  • invite them to decide whether they wish to continue with or modify their request, and
  • advise the requester of their right to seek a review of the charges by the Ombudsman.

Choosing not to charge

The Community Probation Service is not obliged to charge for requests, and may choose not to if:

  • it would facilitate good relations with the public
  • it would assist the Service with its work in the public interest, or
  • the requester is a Member of Parliament.
