7.1 Revocation by Prison Manager

The Prison Manager (or his / her authorised delegate) must revoke a segregation direction for directed protective custody or for the purpose of security, good order, or safety if there ceases to be any justification for continuing to restrict or deny the opportunity of the prisoner to associate with other prisoners under the relevant section of the Corrections Act 2004.

The Prison Manager (or his / her authorised delegate) may also revoke a segregation direction for the purpose of medical oversight, but only where the medical officer advises that there has ceased to be any justification for continuing to restrict or deny the opportunity of the prisoner to associate with other prisoners under section 60(1) of the Corrections Act 2004.

When the Prison Manager (or his / her authorised delegate) revokes a direction for segregation the Chief Executive (or his / her authorised delegate) is to be informed within 7 days of the revocation being made, by being forwarded a copy of the revocation made on the relevant form contained in this National System.

7.2 Revocation by Chief Executive

Any segregation direction may be revoked at any time by the Chief Executive.

7.3 Revocation by Visiting Justice

A Visiting Justice may revoke a direction for segregation for the purpose of security, good order, or safety at any time.

When a Visiting Justice revokes a direction for segregation for the purpose of purpose of security, good order, or safety the Chief Executive (or his / her authorised delegate) is to be informed within 7 days of the revocation being made by being forwarded a copy of the revocation made on the relevant form contained in this National System.

7.4 Prisoner requests for revocation

A prisoner who is subjected to a segregation direction for the purpose of directed protective custody, security, good order, or safety or medical oversight is to be informed that he or she may request that the Chief Executive, or his or her delegate, revoke the direction at any time. A note to this effect has been made on the Prison Manager’s Notification to the Prisoner of the Prisoner’s Placement on Segregation or Continuation of Segregation form.

A request for revocation must be in writing and is to be forwarded by the prison within 2 days of receiving it, and should be received by the Chief Executive, or his or her delegate, within 4 days of the prisoner making the request.

A prisoner who is subjected to a segregation direction for the purpose of security, good order, or safety is also to be informed that he or she may, at any time, request revocation by a Visiting Justice.
