8.1 Prisoner requesting a review of segregation decisions
Sections 58(3)(b), 59(4)(b), and 60(3)

An application from a prisoner requesting a review of any segregation decision is to be forwarded to the Chief Executive, or his delegate, within 2 days of the prison receiving a written request from the prisoner, and should be received by the Chief Executive, or his or her delegate, within 4 days of the prisoner making the request.

A prisoner subject to a segregation direction for the purpose of security, good order, or safety under section 58(1) may apply for a Visiting Justice to review their segregation. The request must be in writing and is to be forwarded by the prison to a Visiting Justice within 2 days of the prison receiving a written request from the prisoner.

8.2 External review of decisions by Ombudsmen

Every prisoner has the right to complain about a segregation direction to an Ombudsman, and must be informed of this right promptly upon being segregated.

8.3 Complaints by prisoners regarding decisions to Ombudsmen or inspectors of corrections
Sections 29, 151-159 & regs. 159-167

Every prisoner has the right to make a complaint about any segregation direction directly to an inspector of corrections and must be advised of this right promptly upon being segregated.

Complaints received from prisoners for an Ombudsman and / or inspector of corrections by prison staff must be forwarded to the Office of the Ombudsmen or the inspector of corrections within 2 days of the prison receiving a written complaint from the prisoner.
